Terms of Service

1. Acceptance of Terms

These Terms of Service (the "Terms") form a binding legal agreement between you ("you," "your," or "User") and SuredaAnalytics LLC, a Florida limited liability company ("SuredaAnalytics," "we," "our," "us," or "the Service"). By accessing, browsing, registering for, or using suredaanalytics.com or any related subdomain (collectively, the "Site"), you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, you must stop using the Site.

2. Eligibility & Age Requirement

You must be at least 18 years of age (and the legal age of majority in your jurisdiction) to create an account or use any paid feature of the Site. By registering you represent and warrant that you meet this requirement. Users located in jurisdictions where regulated sports wagering carries a higher minimum age (for example, 21+ in Florida) must comply with the applicable minimum age when using any information from the Site in connection with real-money activity.

You further represent that you are not on any sports-wagering self-exclusion list and that accessing sports analytics content is not otherwise prohibited by any court order, addiction-treatment plan, or employer policy applicable to you.

3. Nature of the Service — No Gambling, No Financial Advice

SuredaAnalytics provides statistical analysis, projections, data visualizations, written commentary, and similar informational content about professional and collegiate sports. Nothing on the Site constitutes:

• an offer, invitation, or solicitation to place a wager;
• a recommendation to gamble or to bet any specific amount;
• financial, investment, tax, legal, or professional advice;
• a guarantee or warranty of any sporting or betting outcome.

Sports outcomes are inherently uncertain. Past performance of any model, projection, pick, or writeup does not predict future results. You use our content entirely at your own risk.

4. State Law — Florida & Other Jurisdictions

You are responsible for complying with the laws of the jurisdiction from which you access the Site. Legal sports wagering is regulated at the state level in the United States and is prohibited in many jurisdictions.

Florida users: Under Florida law and the 2021 Gaming Compact between the State of Florida and the Seminole Tribe of Florida, the only entity legally authorized to offer online sports wagering to persons physically located in Florida is the Seminole Tribe, currently through its "Hard Rock Bet" platform. SuredaAnalytics is not affiliated with the Seminole Tribe or Hard Rock Bet. Placing wagers with any other online operator while physically located in Florida may be unlawful. Nothing in our content should be construed as an invitation to place a bet with any unlicensed operator.

The Site is intended for users in U.S. states where accessing sports-analytics information is legal. You agree not to use the Site in any jurisdiction where doing so would violate applicable law.

5. Accounts & Security

• You must provide accurate, current information when registering and keep it up to date.
• You are responsible for safeguarding your password and for all activity on your account.
• You must notify us immediately at support@suredaanalytics.com of any unauthorized use.
• One account per person. Sharing, selling, reselling, or transferring account credentials is strictly prohibited and may result in immediate termination without refund.
• We may refuse registration, suspend, or terminate any account at our sole discretion, particularly where we believe the Terms have been violated or where continued access would create legal risk.

6. Subscriptions, Billing & Refunds

Access to premium features requires an active paid subscription. Subscriptions are billed in advance on a recurring basis through Stripe, Inc., our third-party payment processor. By subscribing you authorize us (via Stripe) to charge the applicable fees to your chosen payment method.

• Free trial: If a free trial is offered, your payment method will be charged at the end of the trial unless you cancel before the trial ends.
• Renewal: Your subscription renews automatically for successive periods until cancelled.
• Cancellation: You may cancel at any time through the billing portal. Cancellation stops future renewals; access continues until the end of the current billing period.
• Refunds: Except where required by law, all fees are non-refundable. We may, at our sole discretion, grant partial or full refunds for documented service outages or billing errors.
• Price changes: We may change subscription prices with at least 14 days' prior notice by email. Continued use after a price change constitutes acceptance.

7. Acceptable Use

You agree that you will not:

• use the Site to facilitate, promote, or broker any illegal activity, including unlicensed gambling;
• scrape, crawl, cache, copy, or redistribute our content, data, projections, or writeups in bulk, whether by automated means or otherwise;
• reverse-engineer, decompile, or attempt to extract source code from the Site;
• resell, sublicense, or commercially exploit any part of the Site without prior written consent;
• bypass paywalls, rate limits, authentication, or any other access controls;
• attempt to harm, overload, probe, or disrupt the Site, its servers, or its networks;
• upload or transmit any viruses, worms, or other malicious code;
• impersonate any person or misrepresent your affiliation with any person or entity;
• use the Site if you are on any gambling self-exclusion list applicable to you.

Violation of this section may result in immediate termination of your account and legal action.

8. Data Sources & Licensing

SuredaAnalytics licenses sports statistics data for commercial use from BallDontLie, Inc. ("BDL") under their GOAT Tier commercial API license. BDL's data covers NBA, MLB, and related game and player statistics used throughout the Site. All use of BDL data on the Site is authorized under that commercial license and complies with BDL's Terms of Service. SuredaAnalytics is not affiliated with BallDontLie, Inc.

Tennis analytics data is sourced through commercially licensed third-party API providers. NFL analytics data sourcing is disclosed where applicable.

Important data limitations: Certain advanced metrics displayed on the Site (e.g., contact quality metrics such as exit velocity and barrel rate) may reflect league-season averages rather than individual player-specific values, and will be labeled as such. Some NBA defensive metrics (e.g., clutch performance splits, shot quality against) may be sourced from a cached snapshot and may not reflect real-time updates. These limitations are noted in context on the relevant pages.

All model projections and derived metrics are calculated by SuredaAnalytics using statistical formulas applied to licensed source data. The accuracy of projections depends on the accuracy of the underlying source data, which SuredaAnalytics does not independently verify. See Section 11 (Disclaimers).

8A. Intellectual Property

All content on the Site — including text, graphics, charts, logos, the SuredaAnalytics name and trademarks, models, projection methodologies, writeups, and code — is owned by or licensed to SuredaAnalytics and is protected by U.S. and international copyright, trademark, and other intellectual-property laws. Subject to your continued compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for your personal, non-commercial use.

Third-party data shown on the Site (e.g., official league statistics, odds, injury reports) is attributed to its respective source, obtained under a commercial license, paid subscription, or other lawful public access arrangement as applicable to that source, and is used for editorial and analytical purposes. A full list of data sources and access terms is available on our Data Sources page.

9. Third-Party Links & Services

The Site may contain links to, or reference, third-party websites, tools, or services (including Stripe, Discord, sportsbooks, and data providers). We do not control and are not responsible for third-party content, policies, or practices. Your use of any third-party service is governed by that service's own terms.

9A. Discord Community

SuredaAnalytics operates a Discord community ("the Community") as a supplement to the Site. By joining the Community, you agree to the following additional terms:

• Entertainment only: Any picks, projections, analysis, or commentary shared in the Community are for entertainment and informational purposes only. Nothing shared there constitutes betting advice, investment advice, or a guarantee of any outcome.
• No guaranteed picks: "Confident picks" or similar designations reflect statistical model outputs and historical confidence levels — they are not endorsements or guarantees that any wager will be profitable.
• Personal responsibility: Any gambling or wagering decision you make based on Community content is entirely your own. We are not liable for any financial losses resulting from acting on Community content.
• Conduct: You agree to abide by Discord's Terms of Service and Community Guidelines, as well as any rules posted in the Community server. Disruptive, abusive, or illegal conduct may result in removal from the Community and termination of your Site subscription without refund.
• Access: Community access is provided as a benefit of a qualifying subscription tier. We reserve the right to modify or discontinue the Community at any time without liability.
• Age: You must be at least 18 years of age to participate in the Community.

SuredaAnalytics is not affiliated with Discord Inc. Discord is a trademark of Discord Inc.

10. Responsible Gambling

11. Disclaimers

THE SITE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, TIMELINESS, AND UNINTERRUPTED ACCESS. WE DO NOT WARRANT THAT THE SITE WILL BE ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT ANY PROJECTION, MODEL, PICK, OR WRITEUP WILL BE ACCURATE OR PROFITABLE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL SUREDAANALYTICS, ITS OFFICERS, OWNERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, GOODWILL, DATA, OR OTHER INTANGIBLES) ARISING OUT OF OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE SITE OR ANY CONTENT — EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNTS PAID BY YOU TO US IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED U.S. DOLLARS ($100), WHICHEVER IS GREATER.

13. Indemnification

You agree to indemnify, defend, and hold harmless SuredaAnalytics and its affiliates, officers, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to (a) your use of the Site, (b) your violation of these Terms, (c) your violation of any law or of the rights of a third party, or (d) any gambling, betting, or financial decisions you make based on Site content.

14. Termination

We may suspend or terminate your account and access to the Site at any time, with or without notice, for any reason, including violation of these Terms. Upon termination, your right to use the Site ceases immediately. Provisions that by their nature should survive termination (Sections 3, 8, 8A, 11, 12, 13, 15, 16, 17) will survive.

15. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. You and SuredaAnalytics agree that any dispute arising out of or relating to these Terms or the Site shall be resolved exclusively in the state or federal courts located in Broward County, Florida, and you consent to personal jurisdiction in those courts.

16. Binding Arbitration & Class-Action Waiver

At our election, any dispute may be resolved by final, binding individual arbitration administered by JAMS under its Streamlined Arbitration Rules, seated in Broward County, Florida. You agree to bring any claim only in your individual capacity and not as a plaintiff or class member in any purported class or representative proceeding. The arbitrator may not consolidate more than one person's claims. If this class-action waiver is found unenforceable, then the entirety of this Section 16 is null and void. Nothing in this section prevents either party from seeking injunctive or equitable relief in court for intellectual-property infringement.

17. Changes to These Terms

We may revise these Terms from time to time. Material changes will be announced on the Site or by email to the address on your account. Your continued use of the Site after changes take effect constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Site.

18. Miscellaneous

• Entire agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and SuredaAnalytics regarding the Site.
• Severability: If any provision is held invalid, the remaining provisions will remain in full force.
• No waiver: Our failure to enforce any right is not a waiver of that right.
• Assignment: You may not assign your rights under these Terms; we may assign ours at any time.
